House Committee Passes Tax Legislation, Water Reuse Tax Credit Effort Continues

Last week, the House Ways and Means Committee completed its markup of tax provisions for inclusion in the pending budget reconciliation bill. As expected, the initial House bill does not include a WateReuse-supported provision for an investment tax credit for water reuse projects, nor does it include other provisions being championed by individual Members of the House. Rather, the Committee bill is focused on extensions of major tax provisions that expire at the end of this year as well as on priorities of the President. 

The WateReuse Association has been working with Ways and Means Committee members on legislation to provide a 30 percent investment tax credit to help scale up the use of recycled water by industry. Through our efforts and those of our members, Reps. Darin LaHood (R-IL), Linda Sanchez (D-CA), Claudia Tenney (R-NY), and Brad Schneider (D-IL) introduced the Advancing Water Reuse Act (H.R. 2940) last month. Other Members of Congress have signed on since introduction.  

The Ways and Means Committee markup is only the beginning. WateReuse will continue to advocate for the water reuse investment tax credit as the reconciliation bill progresses through the Senate and in negotiations between the House and Senate. Our focus remains on adding cosponsors to H.R. 2940 to show its broad support, and on introducing a companion bill in the Senate.

EPA Releases New Funding Allotments for FY25

Last week, the U.S. Environmental Protection Agency (EPA) announced state allotments of $8.9 billion for the Clean Water and Drinking Water State Revolving Funds (SRF) in FY 2025. State allotments for the Drinking Water SRF will total more than $4.5 billion, of which $3.4 billion comes from the Infrastructure Investment and Jobs Act of 2021 (IIJA) and roughly $1.13 billion comes from annual appropriations. Of the $3.4 billion from IIJA, $800 million is reserved for projects that address emerging contaminants. On the clean water side, EPA is allotting nearly $4.5 billion for the Clean Water SRF, of which roughly $2.83 billion comes from the IIJA. Of the $2.83 billion, $225 million is reserved for projects that address emerging contaminants. Nearly $1.64 billion is provided for the Clean Water SRF through annual appropriations. Funding for lead service line replacement will be announced later this year. See state-specific details here.

EPA also announced allotments for the Small, Underserved, and Disadvantaged Community Grants Program under the Water Infrastructure Improvements for the Nation Act. EPA is allotting $24 million to states which can use the funding to support water infrastructure projects. The purpose of the program is to enable Safe Drinking Water Act compliance and improve drinking water access in underserved, small, and disadvantaged communities.

EPA to Maintain MCLs for PFOA and PFOS, Extending Compliance Deadlines

EPA Administrator Lee Zeldin announced last week that the Agency will keep National Primary Drinking Water Regulations for PFOA and PFOS, which EPA finalized in April of last year. EPA intends to initiate a rulemaking to extend the deadline for meeting compliance standards for these chemicals from 2029 to 2031. EPA also intends to rescind limits and reconsider the regulatory determinations for PFHxS, PFNA, GenX, and the Hazard Index for mixtures with PFBS. The Administration also reconfirmed its commitment to making polluters, not ratepayers and taxpayers, pay for the cleanup of chemicals like PFOS and PFOA.

FL: Happy Florida Water Reuse Week!

Florida is celebrating Water Reuse week with a Water Reuse Week Proclamation and an annual summit on Wednesday. The summit will take place in Jupiter and will kick off with a tour of the Loxahatchee River Water Reclamation Facility, which recycles 6-7 million gallons of wastewater per day for irrigation needs. Afterwards, participants will gather at the Jupiter Community Center for technical programming, including remarks from WateReuse President Bart Weiss and a keynote speech delivered by Drew Bartlett, Executive Director of the South Florida Water Management District. Programming also includes legislative and policy updates, an update from the Water Research Foundation, and a talk on the FPL-Miami Dade Clean Water Recovery Center – an advanced water purification facility planned for the region.

CA: UCLA Luskin Center for Innovation to Provide Community Engagement and Equity Services for Pure Water LA Project

Last week, the UCLA Luskin Center for Innovation announced its initiative to ensure water equity in the implementation of the Pure Water Los Angeles project, a collaboration between WateReuse Members UCLA, Los Angeles Department of Water and Power (LADWP), and Los Angeles Sanitation and Environment. The Luskin Center's support focuses broadly on community engagement, including understanding and trust of recycled water and affordability. The Luskin Center will analyze potential rate impacts of the project, address potential tap water quality and trust questions, develop and implement training on equity concepts for LADWP staff, support the city's community engagement, and begin a systematic equity assessment of LADWP's customer-facing water programs.

DC: DC Water Names Rabia Chaudhry First Director of Water Supply Resilience

On May 5, WateReuse Member DC Water named water reuse expert Rabia Chaudhry, Ph.D., PE, the Authority's first Director of Water Supply Resilience. Formerly the National Water Reuse Expert at the U.S. EPA, Dr. Chaudhry will lead DC Water's effort to explore alternative water supplies and initiate long-term implementation, including potential water recycling projects. The new position is a result of the need to reduce reliance on the Potomac River as the city's sole water source and work towards identifying and implementing alternatives in case of disruption.

KS: City of Wichita Approves Pilot Study for Industrial and Potable Reuse

Last week, the Wichita City Council voted in favor of a $1.2 million recycled water study, exploring opportunities for the city to recycle water for both industrial and potable reuse. The city's current timeline proposes a study on the potential for industrial reuse late this year, while a study related to potable reuse would be conducted next year. If implemented, the project would be Kansas' first direct potable reuse project. According to city officials, Wichita's average demand in non-drought conditions is 50 million gallons per day, and implementing reuse could potentially meet half of demand, mitigating the need for drought-related restrictions.

Arizona Webcast: Corrosion Control Guidance for Arizona's AWP Program

When Arizona adopted its Advanced Water Purification rules in March 2025, it opened the floodgates for a new generation of direct potable reuse projects. But the new rules also created a need for updated guidance on corrosion control. Simon Horsley, an expert with 20 years of corrosion control expertise, will explain how new processes can affect water chemistry and distribution systems. RO and non-RO treatment processes raise important considerations for product water corrosivity, influenced by the extent of RO treatment and post-conditioning processes. Horsley will review corrosion control requirements and guide water system owners in developing a corrosion control study (CCS) for systems supplied by Advanced Water Purification Facilities. Key topics include system characterization, DPR-specific corrosion risks, desktop evaluations of water quality shifts, demonstration testing approaches, and strategies for implementation and monitoring.
