WateReuse Comments on EPA’s Draft Guidance for Maui Supreme Court Case

In December, the WateReuse Association submitted comments on the U.S. Environmental Protection Agency’s (EPA) draft guidance, “Applying the Supreme Court’s County of Maui v. Hawaii Wildlife Fund Decision in the Clean Water Act Section 402 National Pollutant Discharge Elimination System Permit Program (NPDES) to Discharges through Groundwater.” The Court’s decision and EPA guidance have created the potential for some groundwater recharge projects to have to comply with surface water regulations, despite already being regulated under the Safe Drinking Water Act. Under the draft guidance, entities would need to assess whether the recycled water that is being used to recharge groundwater has the potential to reach a surface water, and if so, whether it would be functionally equivalent to a direct surface water discharge. EPA’s draft guidance briefly highlights some of the characteristics of groundwater projects that could potentially require NPDES permitting.

WateReuse’s comments request that EPA further clarify how this ruling may impact groundwater recharge projects. Our comments emphasize that highly treated recycled water stored in aquifers has been treated for pollutants, meets water quality standards, and should not be characterized as a discharge.

WateReuse Members in CA and AZ Sign Agreements to Protect Colorado River System

In an effort to ensure water security throughout the Colorado River System, the Bureau of Reclamation announced an investment of almost $300 million in water conservation agreements that include funding for water conservation, efficiency, and protection projects through 2025. These investments put particular emphasis on bolstering water security efforts in Lake Mead and Lake Powell, two pivotal reservoirs in the Colorado River System. Notable agreements were established in Coachella Valley Water District (CA), Metropolitan Water District of Southern California (CA), Town of Gilbert (AZ), City of Peoria (AZ), and City of Phoenix (AZ), all members of the WateReuse Association. The continued investment in water security throughout the region speaks to the critical importance of water stewardship, water recycling, and climate resilience projects.

New Interagency Agreement Creates Opportunity for Water Reuse Workforce Development

In late December 2023, the Department of Commerce, Department of the Interior, Department of Agriculture, Department of Labor and Department of Energy, the U.S. Environmental Protection Agency, and AmeriCorps signed a Memorandum of Understanding (MOU) to build out the American Climate Corps. This initiative will create a pathway for young professionals to engage in climate careers, spurring economic development and fostering community-focused leaders that have the tools to impact climate resilience throughout the country. The first workforce cohort will be open to job seekers aged 18-35 and is expected to be established in summer of 2024.The MOU outlines the protection and restoration of waterways as key components of tackling climate change. WateReuse will be reaching out to the organizing agencies to explore opportunities related to water reuse workforce development.

White House Releases Memorandum on Climate-Smart Infrastructure

Late in 2023, the Office of Management and Budget (OMB) released a memorandum that outlines best practices in climate-smart infrastructure for federal agencies to include in their respective financial assistance programs. The memo offers guidance on incorporating risk information into federal property management and federal programs. While the memo does not explicitly reference water reuse in its “best practices” category, it makes reference the White House’s Nature-Based Solutions Roadmap which does include several references to groundwater recharge and reuse-adjacent activities. The OMB memo conveys important information about climate adaptation and infrastructure; however, it misses an opportunity to encourage water reuse as one of the most effective climate resiliency tools.

WateReuse Elects New President and Slate of Officers

At the WateReuse Association’s 2023 fourth quarter meeting, its Board of Directors elected a new slate of officers to lead nation’s only trade association dedicated to advancing laws, policy, funding, and public acceptance of recycled water. Bart Weiss, Chief Officer for Innovation and Resiliency at Hillsborough County Public Utilities in Florida will serve as the Association’s 39th President. Bart brings over 30 years of experience in the industry and nearly two decades of engagement with the WateReuse Association. The Association’s Executive Committee for 2024 will also include: Deven Upadhyay, Executive Officer and Assistant General Manager of the Metropolitan Water District of Southern California (Vice President); John Kmiec, Director of Tucson Water Department (Treasurer); Jon Freedman, Senior Vice President for Global Government Affairs at Veolia Water Technologies & Solutions (Secretary); and Craig Lichty, Area Director and Vice President for Black & Veatch (Past President).

Rosario Cortés Selected as California Interim Managing Director

WateReuse California is proud to announce its selection of Rosario Cortés as Interim Managing Director to lead the activities of the state section. For the past year, Rosario has served as the Regulatory Manager of WateReuse California. In that role, Rosario has advocated for recycled water in the implementation of the water use efficiency legislation, the development of the Cross-Connection Control Policy Handbook, onsite reuse regulations, and funding issues including the Clean Water State Revolving Fund. She has supported our membership by providing timely legislative and regulatory information to our standing committees and seven chapters. The Board of Trustees will work on the recruitment process for a permanent Managing Director in the first quarter of 2024.

Welcome New WateReuse Member!

The WateReuse Association welcomes the Freshwater Society. The Freshwater Society is a Minnesota nonprofit dedicated to inspiring and empowering people to value and preserve water. Since 1968, the organization has used science to engage communities from small towns to the Capitol about how to sustainably improve our water for future generations. Freshwater’s Adopt a River program has supported over 3,200 cleanups that have engaged over 90,000 volunteers in 300,000 hours of service to watershed areas throughout the state. Freshwater’s Minnesota Water Stewards program certifies stewards, who then go on to volunteer their time for watershed districts, cities, counties, and environmental groups; participate on city and local government boards; influence policy; and improve the health of the state’s waters.

CA: State Adopts Direct Potable Reuse Regulations

Following years of research, collaboration, and public engagement, California’s State Water Resources Control Board voted on December 19, 2023 to adopt new regulations allowing for direct potable reuse. Direct potable reuse is a practice which uses multiple phases of proven advanced water treatment technology to transform recycled water into safe, reliable purified water, for blending directly into a community’s existing drinking water system. The new regulations create additional flexibility by allowing advanced purified water to be added directly into drinking water systems where it isn’t feasible to first blend it into a water body like an aquifer or reservoir.

The 4th Annual WateReuse Nevada Symposium will take place on January 29, 2024 at the Tuscany Suites & Casino in Las Vegas. The day-long event will explore water reuse trends in both Northern and Southern Nevada, inland water reuse, scientific advances in reuse, and industrial water reuse. Hear from experts from Truckee Meadows Water Authority, Southern Nevada Water Authority, University of Nevada Las Vegas, and University of Nevada Reno.
